Terms of service

1. Seller

The seller is 1490 s.r.o., Company ID 05235847, VAT ID CZ05235847, registered office at Sudkův Důl 10, 395 01 Obrataň, Czech Republic, registered under file number C 25065 with the Regional Court in České Budějovice (“UTOPIA” or “we”).

These terms govern purchases made through utopia.direct. If you purchase as a business in connection with your commercial activity, certain consumer rights do not apply.

2. Products and orders

The product description, price, availability and any special conditions are shown on the relevant product page. Images are illustrative. Natural differences between batches, colour or sediment do not by themselves constitute a defect if consistent with the nature and description of the product.

You place an order by adding products to the cart, entering the required details, choosing an available delivery and payment method, and submitting the order. You can review and correct the details before submission.

The minimum value of goods in an order requiring delivery is CZK 1,000 including VAT. Delivery charges do not count towards this minimum.

By submitting the order, you place a binding order for the products in your cart. The purchase contract is formed when the automated order confirmation reaches the email address provided with the order.

The contract is concluded in Czech or English according to the shop language used when placing the order. We retain order information in accordance with our legal obligations and Privacy Policy.

3. Prices and payment

Prices include VAT unless expressly stated otherwise. Before submitting the order, you will see the total price of the products, delivery and any other charges.

You may pay using the methods displayed in checkout for the particular order. Their availability may vary according to the delivery country, currency and device used.

Online payments are processed by the relevant payment service providers. UTOPIA does not receive your complete payment-card details.

For a bank transfer, follow the payment details and instructions in the order confirmation or invoice. The order is paid when the full amount is credited to the seller's account.

If a payment fails or cannot be matched to the order, we will contact you using the details supplied with the order.

4. Delivery and acceptance

General delivery information is available on the Shipping page. The delivery methods available to you and their final prices are displayed at checkout before you submit the order.

The delivery options may vary according to the delivery address and the contents of the order.

Messenger delivers UTOPIA orders only within the Czech Republic and to supported Bratislava postcodes. Other carriers deliver to the rest of Slovakia and other countries if an option is displayed at checkout for the address.

We recommend checking the parcel for damage when accepting it. Where possible, photograph visible damage and record it with the carrier. Neither photographs nor a carrier record are a condition for exercising your statutory rights against the seller.

The risk of damage to the goods passes to a consumer upon receipt. If a consumer appoints a carrier not offered by the seller, the relevant provisions of Czech civil law apply.

5. Alcohol: 18+ only

Alcoholic beverages may only be ordered by persons aged 18 or over. By submitting an order containing alcohol, you confirm that you have reached the age of 18.

A parcel containing alcohol may only be accepted by a person aged 18 or over. The seller or appointed carrier will verify the recipient's age when handing over the parcel. If the recipient cannot prove the required age, the parcel will not be handed over.

This restriction does not apply to orders containing only non-alcoholic products.

6. Changing or cancelling an order

If you need to change or cancel an order, contact ivo@utopia.direct as soon as possible.

If the order has not yet been handed to the carrier, we will try to accommodate your request. Changing the order contents may affect its price, delivery charge or the delivery methods available.

If payment cannot be verified, or if information required for delivery is incomplete or clearly incorrect, we may suspend processing and ask you to correct the issue.

After the purchase contract has been formed, the seller may withdraw from it only for reasons permitted by law, for example if performance becomes impossible or the customer fails to pay even within an additional reasonable period.

We will notify you of a cancellation or withdrawal without undue delay. Any payment already received will be returned by the same method unless agreed otherwise.

This does not affect a consumer's statutory right of withdrawal.

7. Defects, complaints and withdrawal

The seller is responsible for defects to the extent required by applicable law.

You may make a complaint by emailing ivo@utopia.direct. No particular form is required.

Acceptance of a complaint cannot be made conditional on the original packaging. A copy of the invoice is not necessary if the purchase can be proven in another way. Making a consumer complaint is free of charge.

8. Personal data and cookies

Information about our processing of personal data is provided in our Privacy Policy.

The website uses technologies necessary for operation, security, the shopping cart and completion of an order. Analytics, advertising and other optional technologies are used only according to the choice you make in the privacy settings.

You may change your optional-cookie settings at any time using the Cookie settings link in the website footer.

Rejecting optional cookies does not prevent you from browsing the shop or completing an order.

9. Alternative dispute resolution

If a dispute arising from a purchase contract between the seller and a consumer cannot be resolved by agreement, the consumer may submit it for out-of-court resolution.

10. Final provisions

The contract is governed by Czech law. For consumers, this does not prejudice mandatory rights granted by the law of the country of their habitual residence.

The seller may make reasonable changes to these terms. A change does not affect contracts formed before the revised version takes effect.

The version in force when the purchase contract is formed applies to the particular order.

These terms are effective from 7 September 2026.
